Terms and Conditions

The terms on which Jolt Crest provides themed event programmes, and on which this website may be used.

Last updated: 13/10/2025 · Jolt Crest, joltcrest.com

This document is an informational template prepared for this website. It is not legal advice and it should be reviewed by a lawyer qualified in New Zealand before you rely on it.

1. The service provider and the scope of these terms

These terms apply to the website joltcrest.com and to event programmes provided by Jolt Crest, 14 Yewlett Crescent, Frankton, Queenstown 9300, New Zealand ([email protected], +64 344 220 99). Where an individual written agreement for an event differs from these terms, the agreement prevails.

2. Definitions

  • Event - the programme delivered on an agreed date at a venue chosen by the client.
  • Programme - the activities, crew, equipment, dressing and timings listed for the chosen format.
  • Package - the programme as described for a given format, including transport, set-up and pack-down.
  • Enquiry - a request for availability and a quote, sent through the form, by email or by phone.
  • Client - the company or individual who signs the agreement and pays for the event.
  • Chip - a symbolic prop used in the casino-style formats. It carries no denomination and no value.

3. The nature of the service

We provide on-site themed entertainment programmes. The service is not gambling within the meaning of the Gambling Act 2003 of New Zealand: there is no consideration staked and no prize of value, so the elements that define gambling are absent.

  • Chips are props. They are not sold, cannot be bought, cannot be topped up and are collected at the end of the programme.
  • Chips, points and results are not exchanged for money, goods, vouchers or any other thing of value.
  • No participant obtains any financial or property benefit from the outcome of an activity.
  • There are no stakes of money or goods, and no cash winnings.
  • There is no online casino and no play over the internet. Everything happens in person at the venue.
  • Admission to our evening programmes is restricted to guests aged 20+ and over.
  • The client pays for the organisation of an event, not for participation in a game.

4. Using the website and the form

The website is published for information. Descriptions, package contents and indicative prices are an invitation to enquire, not an offer capable of acceptance. The enquiry form may be used to ask about a real event only; sending automated, abusive or deliberately false submissions is not permitted, and we may block access where it happens. Content on the site is ours and may not be republished commercially without our written consent.

5. Enquiries and how an agreement is formed

An enquiry does not reserve a date. We check availability, discuss the package and the venue conditions, and send a written quote. The date is held only when the client confirms that quote in writing and the agreement is signed. Until that point the date remains available to other enquiries, and we will tell you if someone else is asking about it.

6. Prices and payment

  • Prices published on this site are indicative planning prices for the whole event, not per person. Each listing shows a starting figure for the package as described and a planning range. The binding figure is the total in the written quote.
  • All figures include GST.
  • Included in the price: the programme, team and equipment listed with the format; planning, run sheet and on-site coordination; transport anywhere in New Zealand; set-up and pack-down outside the programme hours; GST.
  • Not included, and organised and paid for by the client: venue hire, including furniture, power and bathrooms; catering and drinks; accommodation for your guests; gifts for guests; a photographer or videographer.
  • Payment terms: a deposit of 20-40% once the agreement is signed, with the balance due 5-10 days before the event. Payment is by bank transfer against an invoice.
  • A smaller number of guests than the package limit does not reduce the price, because the cost is the crew, the equipment, the transport and the set-up time.
  • Programme hours do not include set-up or pack-down: set-up takes up to 3 hours before the event, pack-down up to 1-2 hours after it.

7. Preparation and delivery

The client provides the venue or site and is responsible for it being suitable and available. Each format page lists what the room or site must have. In particular the client ensures:

  • the floor area, ceiling height and access stated for the chosen format;
  • power as stated, on the number of circuits stated;
  • furniture, bathrooms and cloakroom, unless the format says we bring them;
  • vehicle access and somewhere to unload during the set-up window;
  • any venue, landowner or council permission the event needs, including permission for marquee pegs or ballast and for open flame;
  • availability of the room for the set-up and pack-down windows: set-up takes up to 3 hours before the event, pack-down up to 1-2 hours after it.

If conditions on the day differ materially from what was agreed and that prevents part of the programme from running safely, we will deliver what can be delivered and the fee remains payable in full. We will always tell the client about such a problem as soon as we see it.

8. Transfers and cancellation

  • A date may be transferred once, subject to availability, if the client asks at least 21 days before the event. The deposit carries over to the new date.
  • Cancellation by the client more than 30 days before the event: the deposit is retained to cover planning and allocation already done.
  • Cancellation 30 days or fewer before the event: the deposit is retained, and documented costs already committed on the client's behalf (printing, subcontracted crew, hired equipment) are payable.
  • Cancellation 7 days or fewer before the event: the full fee is payable, because crew and equipment can no longer be re-allocated.
  • If we cancel for a reason within our control, any amounts paid are refunded in full within 10 working days.
  • Cancellation or transfer requests must be in writing to [email protected].

9. Consumer rights and the right to change your mind

Where the client is a consumer, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 apply to our services and nothing in these terms limits rights that cannot be excluded by agreement. New Zealand law does not give a general statutory cooling-off period for services of this kind, so cancellation and transfer are governed by section 8 above. Those terms are written for an event booked for a specific date, where the date itself is the thing being reserved.

10. Complaints

Complaints should be sent in writing to [email protected] or to 14 Yewlett Crescent, Frankton, Queenstown 9300, New Zealand, with the event date, what happened and what you would like us to do. We acknowledge within 5 working days and answer substantively within 14 days. If we cannot agree, a consumer may take a claim to the Disputes Tribunal of New Zealand within its monetary limits, or to the courts.

11. Liability and events outside our control

We are responsible for delivering the programme described in the agreement with reasonable care and skill. We are not responsible for the venue itself, for catering or drinks supplied by others, for the behaviour of guests, or for loss of property that guests bring to the event. Our liability for any event is limited to the fee paid for that event, except where the law does not allow such a limit.

Neither party is liable for failure caused by something genuinely outside its control - including severe weather, earthquake, fire, flood, power failure at the venue, a public health restriction or a transport closure. In that case we will offer a new date or refund amounts paid for parts of the programme not delivered.

12. Final provisions

These terms are governed by the law of New Zealand, and the courts of New Zealand have jurisdiction. Personal information is handled as described in our Privacy Policy. Participation rules for guests are set out in our Responsible Entertainment Rules. These terms take effect on 13/10/2025; we may amend them for future enquiries, and the version that applies to an event is the one in force when its agreement is signed.
